‘Only Yes Means Yes’: Legal Reform, Criminal Justice Practice and Research Challenges in Spain
In 2022, Spain introduced a major reform of its sexual offences legislation (Organic Law 10/2022), widely known as the “Only Yes Means Yes” law. The reform redefined sexual assault around the absence of consent, eliminating the distinction between abuse and aggression and placing affirmative consent at the centre of the legal definition. While the reform generated intense public and political debate, much less attention has been paid to how such legal change translates into everyday criminal justice practice.
This seminar will first provide an overview of the reform and situate it within broader criminological discussions on consent, sexual violence, and attrition in the criminal justice process. It will then introduce and discuss the research questions currently being developed for an ongoing project focusing on the police phase. The aim is to examine how the reform may be shaping police practices, how consent and credibility are approached in early decision-making, and how these initial assessments may influence the trajectory of cases. Particular attention will be given to the methodological design, including the development of qualitative interviews, in order to invite feedback and comparative reflections.
Cristina Vasilescu is a criminology lecturer and researcher at the University of Girona. Her research focuses on gender and criminal justice, with particular attention to how penal institutions respond to women both as offenders and as victims of crime. Grounded in feminist criminology and a gender-responsive approach, her work has examined the probation system from a gender perspective, the criminalisation of sex work in Spain, gender-based violence, and gender-based cyberviolence. Her current research explores the implementation of Spain’s 2022 consent-based sexual offences reform, with a specific focus on early-stage criminal justice decision-making.
